Trump Calls for Jail Time for Flag Burners Amid Rising Protests
Speaking at Fort Bragg in North Carolina, former President Donald Trump reignited controversy by calling for one-year jail sentences for anyone who burns the American flag. “They proudly carry flags of other countries, but they don’t carry the American flag. They only burn it,” Trump said. “People that burn the American flag should go to jail for one year.”
The remarks come amid ongoing anti-ICE protests in cities like Los Angeles, Dallas, and Austin. In L.A., demonstrations entered their fifth day, marked by clashes with law enforcement, arson, and arrests. Trump deployed 4,100 National Guard troops and 700 Marines to safeguard federal assets, a move challenged by California Gov. Gavin Newsom.
Trump’s proposal faces legal hurdles. A landmark 1989 Supreme Court ruling—Texas v. Johnson—protects flag burning as constitutionally protected speech under the First Amendment. Still, Trump remains adamant. “They say it’s not constitutional,” he said. “Well, make it constitutional.”
Despite repeated attempts, Congress has been unable to pass laws banning flag desecration, with each effort struck down as unconstitutional. Yet Trump continues pushing the issue as a rallying cry to his base.
