
Lawsuit Against Chris Martin “Dead on Arrival”
Legal experts told Fox News Digital that any lawsuit by Andy Byron, the former CEO of Astronomer, over the Kiss Cam incident at a Coldplay concert would be “dead on arrival.”
Employment attorney Ron Zambrano said, “He had no reasonable expectation of privacy at an event like that.
There’s a waiver of any such rights at the point of ticket purchase.” Byron has not filed any court documents, and experts agree his legal options are very limited.
The Kiss Cam Incident and Fallout
During Coldplay’s July 16 show, Byron appeared on the Kiss Cam with Kristin Cabot, head of Astronomer’s HR department.
Chris Martin sang about the couple, joking, “either they’re having an affair or they’re just very shy.” The moment went viral, sparking rumors of an affair. Both Byron and Cabot resigned from their positions shortly after. Astronomer’s board launched a formal investigation and said, “Our leaders are expected to set the standard in both conduct and accountability.”
No Privacy or Defamation Case
Trial attorney John W. Day explained Byron’s privacy and defamation claims would likely fail. “He had no expectation of privacy at the Coldplay concert because it was a public event,” Day said. He added Byron would have to prove Martin “knew that he was not having an affair” to win a defamation case. Zambrano advised Byron to “keep his head down and avoid torpedoing his future job prospects over something like this.”
